1. Service description

Aimward is a personal productivity tool built around long-term goals, tasks, focus, reviews, milestones, and data analytics. We currently provide versions for iOS, iPadOS, and macOS, and the specific features are subject to the actual in-app display.

Aimward is mainly intended for personal use. Without our prior written permission, you may not use Aimward or any of its functions, content, data interfaces, or membership benefits for sale, rental, sublicensing, commercial hosting, batch services, or other commercial purposes.

We may adjust Aimward's functions, interface, platform support, membership benefits, or service forms according to product planning, system capabilities, legal and regulatory requirements, or operational needs.

2. Accounts and eligibility

Aimward may support local use and may also support synchronization, subscriptions, purchase restoration, or other capabilities related to Apple ID, iCloud, or other platform services. You should properly safeguard your device, system account, Apple ID, and related access permissions.

If data loss, abnormal membership benefits, sync conflicts, or other losses occur because you actively share your device, share a system account, disclose account information, authorize others to use it, or operate it improperly, you are responsible for those consequences.

If Aimward later provides services that require registration or login, you must ensure that the information you submit is true, accurate, lawful, valid, and updated in a timely manner.

3. Membership and paid subscriptions

Aimward may provide membership services or other paid features. After purchasing membership, you may use the corresponding membership benefits during the valid membership period. The specific benefits are subject to the in-app display, App Store product page, or purchase page description.

Membership benefits are limited to the purchaser on devices lawfully owned or authorized for use by that purchaser. Without our permission, you may not transfer, rent, sell, lend, share, distribute, sublicense, bypass subscription verification, crack paid features, or otherwise obtain membership benefits abnormally.

Aimward currently provides purchase, subscription, renewal, cancellation, and refund capabilities through Apple App Store. Subscription fees, trial periods, renewal cycles, cancellation methods, and refund handling are subject to Apple rules and the App Store page.

If you want to cancel auto-renewal, you should do so through the Apple ID subscription management page before the current subscription period ends. Uninstalling the app does not automatically cancel the subscription.

If you purchased Aimward membership through the App Store and want to request a refund, submit the request through the official Apple refund process. Refund review and results are decided by Apple under its policies, and we usually cannot directly process App Store order refunds.

If you use membership services through illegal, non-compliant, fraudulent, cracked, shared, resold, or otherwise prohibited means, we may restrict, suspend, or terminate the relevant benefits and reserve the right to pursue liability.

4. User content and data

Goals, tasks, reviews, milestones, focus records, quantitative metrics, settings, and other content that you create, enter, store, or generate in Aimward remain subject to your lawful rights.

Aimward adopts a local-first product design. In general, data you create is stored locally on your device by default. If you actively enable iCloud sync, relevant data may be synchronized through Apple CloudKit among devices signed in with the same Apple ID. iCloud sync depends on Apple systems, network, account status, device settings, and CloudKit services, and we do not guarantee that sync will always be uninterrupted, delay-free, or completely conflict-free.

You should confirm and back up data that is important to you. If data is lost, damaged, or unavailable due to device damage, system failure, accidental deletion, sync conflicts, third-party service issues, account permission changes, or your own actions, we will provide reasonable assistance but are not liable for indirect losses beyond the scope required by law.

You may not use Aimward to store, generate, distribute, or process any content that is illegal, infringing, harmful to others' lawful rights, or contrary to public order and good morals.

5. Use rules

When using Aimward, you must comply with laws and regulations, these Terms, and relevant platform rules. You may not engage in the following conduct:

If we discover or reasonably believe that you have engaged in the above conduct, we may take measures based on the circumstances, including limiting functions, suspending or terminating services, canceling membership benefits, refusing refunds, preserving evidence, or pursuing legal liability.

6. Intellectual property

Aimward's software, interface design, icons, copy, interactions, code, trademarks, logos, product names, functional structure, and related content, except third-party content or user-created data, are protected by intellectual property rights owned by us or the relevant right holders.

Without written permission from us or the relevant right holder, you may not copy, modify, adapt, translate, distribute, sell, rent, reverse engineer, create derivative works from, or otherwise use any protected Aimward content.

Product suggestions, feedback, comments, or improvement proposals you submit to us are deemed to authorize us to use, evaluate, modify, implement, and apply them to products or services worldwide free of charge, without paying you additional fees. This does not give us ownership of the personal data content you create in Aimward.

7. Privacy protection

We value user privacy and data security. For how we handle personal information, device permissions, local data, iCloud sync, and other privacy matters, please read the Aimward Privacy Policy.

These Terms and the Privacy Policy together form important rules for your use of Aimward. If they differ on personal information processing matters, the more specific explanation in the Privacy Policy prevails.

8. Third-party services

Aimward may use system capabilities or services provided by Apple, including App Store, StoreKit, iCloud, CloudKit, notifications, calendars, widgets, Live Activities, Siri, App Intents, and more. When using these capabilities, you may also be bound by the Apple Media Services Terms and Conditions, App Store rules, Apple's privacy policies, and system settings.

Aimward may also use lawfully authorized third-party software, open-source code, or system frameworks. Relevant third-party licenses may be displayed through the app, website, installer, open-source notices, or other reasonable methods. You should comply with those third-party license terms.

If Apple, the operating system, network services, third-party software, or other causes beyond our control result in function abnormalities, sync failures, purchase failures, notification delays, or service unavailability, we will assist with troubleshooting within a reasonable scope but are not liable beyond what the law requires.

9. Service changes, interruption, and termination

We may change, interrupt, or terminate Aimward functions, services, membership benefits, supported platforms, or use rules for product operation, technical upgrades, legal and regulatory requirements, platform policies, or security reasons.

If you violate these Terms, laws and regulations, or platform rules, we may suspend or terminate all or part of the services provided to you and cancel relevant benefits depending on the circumstances.

You may stop using Aimward at any time. Stopping use or uninstalling the app does not cancel an App Store subscription. To cancel a subscription, use the Apple ID subscription management page.

10. Disclaimers and limitation of liability

Aimward is a personal productivity and long-term goal management tool and does not constitute legal, medical, financial, investment, psychological, or other professional advice. You should make independent judgments based on your own situation and bear the consequences of your decisions.

To the maximum extent permitted by law, we do not promise that Aimward will meet all of your needs, or that services will always be continuous, timely, secure, error-free, or that all defects will be fixed immediately.

11. Use by minors

If you are a minor, you should use Aimward with the consent and guidance of your legal guardian. The guardian is responsible for the minor's use and the resulting consequences.

Aimward is primarily intended for users with independent planning, recording, and management capabilities. We do not actively collect personal information from children. If you believe we may have processed information related to a minor, contact us using the methods listed in these Terms.

12. Updates to these Terms

We may update these Terms according to laws and regulations, product functions, platform policies, or operational needs. Updated Terms will be published through the app, website, or other reasonable methods.

If you do not agree to the updated Terms, you should stop using Aimward. If you continue using Aimward, you are deemed to accept the updated Terms.

13. Governing law and dispute resolution

The formation, effectiveness, performance, interpretation, and dispute resolution of these Terms are governed by the laws of the People's Republic of China, excluding conflict-of-law rules.

Disputes arising from these Terms or the use of Aimward should first be resolved through friendly consultation. If consultation fails, either party may bring a lawsuit before the people's court with jurisdiction over the domicile of Hangzhou Clearflux Information Technology Co., Ltd.

If the laws of your country or region provide consumer protection, data protection, jurisdiction, or other mandatory rights that cannot be excluded or limited by agreement, these Terms do not exclude or limit those rights.

14. Additional Terms for Apple Platform Applications

This clause applies exclusively to all scenarios where you download, acquire, install and use Aimward on Apple-branded hardware devices via the Apple App Store. You acknowledge and agree to the following provisions:

This Aimward End User Agreement only binds you and Hangzhou Clearflux Information Technology Co., Ltd., and no contractual relationship shall be established between you and Apple Inc. We shall bear full independent liability for all matters arising from Aimward’s software, functions, content and services. All usage rules set forth in this Agreement shall not conflict with the effective version of Apple Media Services Terms and Conditions.

The software license we grant you for Aimward is a non-transferable personal license: you may use this App on all Apple devices lawfully owned or controlled by you, within the scope permitted by Apple Media Services Terms and Conditions. You may grant access permissions to linked authorized accounts under Apple’s official Family Sharing and Volume Purchase Program rules.

We shall fully provide function maintenance, inquiry support and technical services related to Aimward in accordance with this Agreement and the laws of the People’s Republic of China. You and we jointly confirm that Apple has no obligation to provide auxiliary maintenance, fault repair or manual technical support for Aimward.

To the extent warranties cannot be excluded by mandatory law, we shall assume all express and implied product warranty obligations for Aimward. If Aimward fails to meet corresponding warranty commitments, you may submit a purchase refund request to Apple, which shall refund the corresponding amount paid via App Store in accordance with platform rules. Within the maximum scope permitted by law, Apple shall not be liable for any additional compensation arising from warranty breaches; all warranty-related claims, losses and indirect damages shall be borne solely by us.

We shall independently handle all claims raised by users or third parties arising from your use of Aimward, including without limitation product liability, regulatory compliance, consumer protection and privacy infringement disputes. Nothing in this Agreement shall unreasonably limit our statutory compensation liability to you beyond mandatory legal provisions.

If any third party alleges that Aimward or your use thereof infringes its intellectual property rights, we shall independently complete all investigations, defenses, settlements and infringement indemnification work, and Apple shall bear no related liability.

You represent and warrant that: (1) your location or residence is not within any country or region subject to U.S. government trade embargoes, sanctions, or jurisdictions designated by the United States as state sponsors of terrorism; (2) you are not listed on any U.S. federal restricted or denied entity or individual transaction lists.

While using Aimward, you must fully comply with all applicable third-party platform agreements, including but not limited to Apple Media Services Terms and Conditions, App Store Developer & User Guidelines, iOS/macOS System Service Agreements, carrier network terms, and iCloud cloud service license terms.

You and we jointly confirm that Apple Inc. and its wholly-owned global subsidiaries and affiliates are third-party beneficiaries of this Chapter “Additional Terms for Apple Platform Applications” under this Agreement. You agree that upon your acceptance of all terms of this Agreement, Apple shall independently hold and may directly enforce all rights stipulated in this Chapter against you.

The corporate entity and contact email set out in Clause 15 of this Agreement shall be your exclusive channel for inquiries, complaints and claims regarding Aimward products and services. Apple shall not handle any user consultations or disputes related to this App.
